Title: Withholding Pension Benefits from Incarcerated Public Employees
Vote to pass a bill that prohibits public servants who are convicted of crimes associated with that individual's office from receiving government retirement benefits while incarcerated.
-Defines "public servant" as a current or former public employee or an elected official whether a member, former member, or retiree under the provision of any public retirement system (Sec.1). -Specifies that an incarcerated public servant shall be considered deceased for purposes of his or her retirement benefits for spouses and children that are his or her designated beneficiaries, provided the amount payable to the spouse or children does not exceed the amount that would otherwise be payable to the public servant (Sec. 1).

NOTE: THIS LEGISLATION IS CONTINGENT ON THE PASSAGE OF A CONSTITUTIONAL AMENDMENT PROPOSED IN SEPARATE LEGISLATION, THEREBY REQUIRING A TWO-THIRDS MAJORITY IN EACH CHAMBER FOR PASSAGE AND APPROVAL BY A MAJORITY OF VOTERS IN THE NEXT ELECTION TO BE ENACTED.
