Vote to concur with Senate amendments and pass a bill that limits a retired teacher's ability to collect retirement benefits after being rehired beginning July 1, 2010.

Highlights:

-Prohibits retired teachers from receiving retirement benefits during a period of reemployment, unless the superintendent and personnel director of the school have certified to the Board of Elementary and Secondary Education and the Board of Trustees that a shortage of teachers exists in the critical shortage area in which the retired teacher was hired to work (Sec. 1). -Defines "retired teacher" as a full-time or part-time classroom teacher who teaches any student in kindergarten through 12th grade in a critical teacher shortage area (Sec. 1). -Prohibits the extension of benefits to members not defined as retired teachers for the duration of their reemployment (Sec. 1). -Prohibits the superintendent and personnel director of a school from certifying that a critical shortage area exists prior to advertising the position in the official journal of the employer's governing authority on at least 2 occasions (Sec. 1). -Requires a certified applicant who is not a retiree to be hired for a position before any certified retired teacher is employed, unless fewer than 3 teachers certified in the critical shortage area have applied (Sec. 1).
