Title: DNA Sampling in Felony Cases

Vote to adopt a conference that requires anyone convicted of a felony to submit a blood or an oral or biological sample to the Kansas Bureau of Investigation within ten days of their conviction or upon arrival at the correctional facility. From January 1, 2007 to June 30, 2008, any person charged with committing a felony against a person shall be required to submit a DNA sample at the time of fingerprinting. After July 1, 2008, a person arrested for any felony shall be required to submit the sample at the time of fingerprinting. If the charges are dismissed, the statute of limitations for the crime expires, or the person is acquitted, then the sample will be destroyed upon the person’s request, but a record will be kept in the KBI database.
