Vote to pass a bill that exempts a student who is not a citizen or a lawful permanent resident of the United States from paying nonresident tuition and fees for enrollment in an institution of higher education.

Highlights:

• Specifies that a student is eligible for resident tuition, regardless of immigration status, if the student has (Sec. 2):
• Attended school for 3 years in Oregon immediately prior to receiving a high school diploma or leaving school before receiving a high school diploma;
• Attended school for 5 years in any territory or state of the United States, the District of Columbia, or Puerto Rico; and
• Demonstrated intent to become a citizen or a lawful permanent resident of the United States.

• Specifies that a student who is financially dependent upon someone who is not a citizen or lawful permanent resident of the United States is eligible for resident tuition if the student has (Sec. 2):
• Attended school for 3 years in Oregon immediately prior to receiving a high school diploma or leaving school before receiving a high school diploma; and
• Attended school for 5 years in any territory or state of the United States, the District of Columbia, or Puerto Rico.

• Limits eligibility for resident tuition to 5 years after initial enrollment in a higher education institution (Sec. 2).

• This act is effective for the 2012 fall academic term (Sec. 3).
