Vote to pass a bill that prohibits the use of cellular telephones or other handheld wireless communication devices while driving.

Highlights:

  • Prohibits voice communications and typing whether for text messaging or other purpose on a cellular device while driving a motor vehicle (Sec. 1).
  • Establishes exemptions to these prohibitions in the following circumstances (Sec. 1):
    • A volunteer firefighter, ambulance attendant, Emergency Medical Technician, or other emergency care-giver, using the device for reasons within his or her job's specifications;
    • A police officer or other enforcer of the law who is acting within the scope of his or her employment;
    • A person who is reporting or responding to a medical emergency, safety hazard, or criminal activity;
    • A person licensed with the FCC as an amateur radio operator, providing communication services while in transit; and
    • An employee or contractor of a public utility who needs a handheld cellular device for his or her obligations of employment.
  • Defines "Handheld Wireless Communication Device" as any handheld device used for the transfer of data or information without the use of conductors or wires, etc., including but not limited to the following (Sec. 1):
    • Cellular phones;
    • Personal digital assistants;
    • Pagers; and
    • Text messaging devices.
  • Establishes that a person who violates any provision of the above law is guilty of a misdemeanor and is fined the following (Sec 1):
    • $50 for a first offense;
    • $100 for a second offense within seven years of the initial violation; and
    • $250 for a third offense within seven years of the initial violation.
