Title: Requires Certain Employers to Use E-Verify

Vote to pass a bill that requires private employers who seek to contract with a public entity to certify that all employees are legally authorized to work in the United States using the Department of Homeland Security's E-Verify program.

Highlights:

  • Prohibits private employers from bidding on or contracting with a public entity for the performance of services unless the employer submits a sworn affidavit verifying that (Sec. 1):
    • The employer is registered with and participates in the E-Verify program to verify that all of its employees are citizens or documented immigrants; and
    • The employer shall continue to use E-Verify to verify the legal status of all new employees for the duration of the contract.
  • Specifies that a violation of this act will result in the cancellation of all public contracts and ineligibility for any public contract for 3 years from the date the violation is discovered (Sec. 1).
  • Specifies that any person, contractor or employer who complies with this act shall not be civilly or criminally liable for refusal to hire or retain an individual who is found by the E-Verify program to be an undocumented immigrant (Sec. 1).
  • This act is effective January 1, 2012 (Sec. 1).
