• Authorizes a negotiated plan to base unrequested leave of absence, discharge, and demotion decisions on a teacher’s subject matter licensure fields and evaluation outcomes (Secs. 2 & 4).

• Requires school boards to make discharge, demotion, and unrequested leave of absence decisions based on a teacher’s subject matter licensure fields and most recent evaluation outcome, beginning no later than the 2016-2017 school year (Secs. 3 & 4).

• Requires school boards to publish any unrequested leave of absence, discharge, or demotion plan due to discontinuance of position or lack of pupils (Secs. 3 & 4).

Vote Smart's Synopsis:

Vote to pass a bill that authorizes teacher performance evaluations to be considered in teacher dismissals.

Highlights:

• Authorizes a school board to base unrequested leave of absence or dismissal decisions on a teacher's evaluation outcome, beginning no later than the 2016-2017 school year (Secs. 3 & 5).

• Requires dismissals and demotions in a particular licensure field to be implemented based on the following (Secs. 3, 5 & 6):
• The most recent evaluation outcome for teachers beginning with the “least effective” to “most effective” category; and
• The least to greatest seniority within each “effective” category.

• Specifies that unrequested leave of absence for teachers categorized as “ineffective” or less lasts for 1 year before the teacher’s right to reinstatement expires (Sec. 3).

• Prohibits the use of salary as a factor in dismissal or demotion decisions (Sec. 5).

• Requires a school board to publish implemented dismissal and demotion plans (Sec. 5).
