Vote to pass a bill that allows a person convicted of a Class D felony or a series of Class D felonies from a single incident to petition, ten years after being convicted, to have the record expunged. The bill specifies that an individual is not eligible to petition if he or she has been convicted of an offense against a minor or a sex offense, has prior felony convictions, has been convicted of a felony since applying to have the record cleared, has not finished any sentence that has been imposed or has not paid any restitution ordered. A person convicted of a misdemeanor or violation or series of misdemeanors arising from a single incident can petition for his or her record to be expunged five years after conviction. This bill increases the fees to have a record expunged to $280 for felony convictions and $50 for misdemeanor violations. The bill also requires that victims or victims’ families are notified and allowed to testify when convicted individuals file a petition. Persons who have their records expunged are exempt from the statute criminalizing possession of a firearm by a felon.
