Highlights:
Prohibits an individual from openly carrying an unloaded firearm that is not a handgun in an incorporated city, whereas existing law prohibits openly carrying an unloaded handgun in unincorporated areas (Sec. 12).
Classifies the open carry of an unloaded firearm that is not a handgun in an incorporated city as a misdemeanor punishable by the following (Sec. 12):
No more than 1 year in county jail;
A fine of up to $1,000; or
Both a fine and imprisonment if the firearm and ammunition are in the individual's immediate possession.
Exempts individuals from the provisions of this bill in certain situations including, but not limited to, the following (Sec. 12):
The individual holding an unloaded firearm is within a place of business, a place of residence, or on private property where the owner of the property allows that individual to carry a firearm;
The firearm is either in a locked container or case and is being transported directly between places where individuals are not prohibited from possessing firearms;
The individual holding an unloaded firearm is a peace officer or an honorably retired peace officer who is authorized to carry such a weapon; or
The individual holding an unloaded firearm is a licensed hunter who is engaged in hunting or going to or returning from that hunting expedition.
