Vote Smart's Synopsis:
Vote to pass a bill that classifies certain undocumented immigrants as in-state students for tuition purposes.
Highlights:
- Authorizes an undocumented immigrant to pay in-state tuition if the student meets the following criteria (Sec. 1):
- Attended high school in Colorado for at least 3 years immediately before graduating from high school or completed a general equivalency diploma (GED) in Colorado; and
- Is admitted to or attends a Colorado institution of higher education within 12 months of graduating or completing the GED.
- Exempts a student who graduated or completed a GED prior to September 1, 2013, from the requirement of admission within 12 months to an institution of higher education if the student has been continuously present in Colorado for at least 18 months immediately prior to enrollment (Sec. 1).
- Requires an undocumented immigrant seeking in-state tuition to submit an affidavit stating that the student has applied for lawful presence or will do so when eligible (Sec. 1).
- Specifies that institutions of higher learning may not classify a student who is an undocumented immigrant as a resident for any purpose except tuition and eligibility for the College Opportunity Fund (Sec. 1).
