Title: Amends Student Immunization Laws
Vote Smart's Synopsis:
Vote to pass a bill that amends student immunization laws regarding exemptions and data collection, effective July 1, 2014.
Highlights:
- Requires all schools to make the immunization and immunization exemption rates of their enrolled student population publicly available upon request (Sec. 2).
- Requires the State Board of Health to implement rules regarding the frequency of immunization exemption form submissions and rules regarding immunization information including the following information (Sec. 2):
- Exemption rates;
- Information gathered from evidence-based research;
- Information gathered from peer-reviewed studies;
- Information gathered from online learning modules; and
- Information gathered from scientific and public health organization resources.
- Requires the Department of Public Health and Environment to establish a joint policy on immunization data collection and sharing and requires the department to provide schools with analysis and interpretation of the data (Sec. 3).

Highlights:
- Requires a student to receive standard immunizations prior to attending school, with the following exceptions (Sec. 2):
- A student whose parent or guardian, an emancipated student, or a student 18 years of age or older who has submitted to the school a complete statement of exemption with all accompanying documents;
- A student who is homeschooled and does not participate in any activity or class at a school with other children; and
- A student who is educated through an online program that does not have additional children in the same location other than the student’s siblings and does not participate in any activity or class at a school with other children.
- Requires a statement of exemption to include the signature of a parent or guardian of a student, an emancipated student, or a student 18 years of age or older who has a personal belief opposed to immunizations, as well as one of the following items (Sec. 3):
- A signed, written disclosure from an authorized medical professional who is permitted and qualified to administer vaccines stating that the parent, guardian, or student received information disclosing the benefits and risks of immunizations to the student and community; or
- A certificate of completion of an online education module developed by the Infant Immunization Program at the Department of Public Health and Environment that discloses the benefits and risks of immunizations to the student and the community.
- Requires a school to make the immunization and exemption rates of their enrolled student population available to the public upon request (Sec. 3).
