Title: Prohibits Mandatory Enrollment In Labor Unions

Vote to override a veto of a bill that prohibits employees from mandatory enrollment into labor unions.

Highlights:

  • Prohibits an employer from requiring an individual to do any of the following as a condition of employment (Sec. A):
    • To join or refrain from joining a labor organization; 
    • To pay any dues, fees, assessments, or other similar charges to a labor organization; or
    • To pay any amount equivalent to, or a portion of, any dues, fees, assessments, or other charges required of members of a labor organization to a charity or third party.
  • Specifies that any agreement, understanding, or practice between a labor organization and an employer that violates the provisions of this bill is unlawful and has no legal effect (Sec. A).
  • Specifies that the provisions in this bill shall not apply to the following (Sec. A):
    • To employees and employers covered by the federal Railway Labor Act;
    • To federal employees and employers;
    • To employees and employers on exclusive federal enclaves;
    • To a case where the bill conflicts with or preempted by federal law; and
    • To a collective bargaining agreement or any other type of agreement between an employer and a labor union entered into before the effective date of the bill.
  • Authorizes an individual who is injured due to a violation of this bill to recover any and all damages and classifies a violation of this bill as a class C misdemeanor (Sec. A).
