Vote to concur with Senate amendments and pass a bill that establishes certain requirements for facilities that perform abortions, effective July 1, 2016.

Highlights:

  • Classifies the failure to dispose of fetal remains in a sanitary manner as a first degree misdemeanor (Sec. 3).
  • Defines “second trimester” as the period of time between the twelfth and twenty-third week of gestation (Sec. 2).
  • Defines “third trimester” as the period of time from the beginning of the twenty-fourth week of gestation through birth (Sec. 2).
  • Prohibits a state agency or a local government entity from expending funds to an organization that owns, operates, or is affiliated with any clinic that performs abortions, except in the following circumstances (Sec. 3):
    • The abortions performed are on fetuses conceived through rape or incest;
    • The abortions performed are medically necessary to preserve the life of the pregnant woman or to avert serious physical impairment, other than a psychological condition;
    • The funds are expended to fulfill the terms of a contract entered into before July 1, 2016; or
    • The funds are expended as reimbursement for Medicaid services provided on a fee-for-service basis.
  • Requires physicians who perform abortions to have admitting privileges at a hospital within “reasonable proximity” to the clinic (Sec. 4).
  • Requires clinics to have a written patient transfer agreement which must include the transfer of the patient’s medical records (Sec. 4).
  • This is a substitute bill sponsored by the House Health and Human Services Committee.
