• Specifies that property is not subject to confiscation if it is reasonably necessary for a person’s employment or personal use and will not be used for criminal activity (Sec. 1).

• Specifies that property is not subject to confiscation if it has evidentiary value (Sec. 1).

• Authorizes the court to decide whether the seizure was proportionate to the crime committed (Sec. 1).

• Establishes that before August 31 of each year, each law enforcement agency will be required to submit information from the previous fiscal year to the office of the state controller, including, but not limited to, the (Sec. 1):

• Name of the law enforcement agency that seized the property;

• Date of seizure;

• Type and description of property seized; and

• Value of property forfeited.
