A vote to concur with house amendments and pass a bill that establishes guidelines for licensing, production, dispersal, and general oversight of medical marijuana.

Highlights:

 

  • Prohibits individuals from purchasing more than 2,000 milligrams of marijuana products or 2.5 grams of dried cannabis leaves or flowers within a 30 day period (Sec. 1).

  • Establishes that all qualifying, registered patients are not subject to arrest, prosecution, or denial or any denial of right, privilege, or discipline by a court if they are found purchasing or possessing useable marijuana (Sec. 1).

  • Defines “usable marijuana” as a medical marijuana product or the dried leaves or flowers of the plant of the genus cannabis in a combustible delivery form, but the term does not apply to any marijuana product that is not certified by the state (Sec. 1).

  • Requires all individuals to apply for and obtain a registration card in order to purchase medical marijuana (Sec. 1).

  • Prohibits an entity from growing or dispensing usable marijuana unless they are registered as a compassion center within the state (Sec. 1).

  • Specifies that a compassion center’s marijuana certificate is valid for 2 years and may be renewed by submitting an application 90 days before its expiration date (Sec. 1).

  • Specifies that the state has the right to revoke any individual’s registry identification card if a material misstatement is made on the registry application (Sec. 1).

  • Specifies that the penalty for all sales of marijuana to unauthorized users is a Class B felony (Sec. 1)

  • Specifies that manufacturing facilities may not possess more than 1,000 plants, regardless of the stage of growth, or more than 3,500 ounces of usable marijuana at any time, regardless of the formulation (Sec. 1).

  • Prohibits possessing or consuming usable marijuana in the following situations or locations (Sec. 1):

    • On a School bus or vehicle used for school purposes;

    • On the grounds of any public or private school;

    • At any location while a public or private school sanctioned event is occurring at that location;

    • On the grounds of a correctional facility; or

    • On the grounds of a child care facility or licensed home day care, unless authorized under rules adopted by the department of human services.
