Title: Authorizes Recreational Marijuana
Vote to pass a bill that authorizes the possession of small amounts of marijuana for recreational purposes by adults over the age of 21, effective July 1, 2017.
Authorizes individuals over the age of 21 to possess marijuana in the following amounts (Sec. 7):
2 ounces or less of dried marijuana;
10 grams or less of hashish;
2 or fewer mature marijuana plants; or
7 or fewer immature marijuana plants.
Prohibits consumption of marijuana in public places and establishes civil penalties for violation in the following amounts (Sec. 7):
$100 or less for a first offense;
$200 or less for a second offense; and
$500 or less for third and subsequent offenses.
Authorizes individuals over the age of 21 to cultivate up to 2 mature marijuana plants or 7 immature marijuana plants per dwelling, and specifies that marijuana harvested shall not count toward the 2 ounce possession limit provided that it is stored in a secure indoor facility on the same property (Sec. 8).
Establishes civil penalties for cultivation of marijuana in violation of the provisions of this bill in the following amounts (Sec. 8):
$100 or less for a first offense;
$200 or less for a second offense; and
$500 or less for third and subsequent offenses.
Specifies that providing marijuana to or enabling the consumption of marijuana by an individual under the age of 21 is a criminal offense and establishes a penalty of not more than 2 years imprisonment, a fine of $2,000 or less, or both (Sec. 9).
Prohibits the manufacture of concentrated marijuana by use of butane or hexane, unless authorized as a dispensary, and establishes a criminal penalty of not more than 2 years imprisonment, a fine of $2,000, or both (Sec. 11).
