Highlights:

  • Requires restrooms, showers, and changing facilities in public school districts and open-enrollment charter schools to be designated for and used only by individuals of the same sex as stated on a birth certificate, driver’s license, or other form of government issued identification (Sec. 2).
  • Prohibits schools from allowing an individual to participate in a school athletic activity that is designated for the opposite sex (Sec. 2).

  • Specifies that these facility restrictions do not apply when an individual with a disability or a child under the age of 8 needs assistance (Sec. 2).

  • Authorizes schools to provide accommodations for special circumstances, including a single-occupancy restroom or the controlled use of a facility for faculty only (Sec. 2).

  • Specifies that contracts for goods or services must not be awarded or refused based on a school’s bathroom policy (Sec. 3).
