Title: Establishes Database of Violent Offenders
Vote to pass a bill that requires the Bureau of Criminal Identification and Investigation to establish and maintain a database of violent offenders.
Requires the Bureau of Criminal Identification and Investigation to establish and maintain a database of violent offenders and qualifying out-of-state violent offenders which it shall make available to local, state, and federal law enforcement (Sec. 1).
Specifies that the violent offender database is not considered a public record (Sec. 1).
Defines “violent offender” as individuals who on or after the effective date of this act have been convicted of, plead guilty to, or are confined as punishment for a variety of offenses including, but not limited to, the following (Sec. 1):
Aggravated murder;
Murder;
Voluntary manslaughter;
Kidnapping;
Abduction that is a felony in the second degree; or
Attempt to commit or conspiracy to commit any of the above crimes;
Defines “qualifying out-of-state offender” as an individual who has committed a qualifying offense in another state and is aware of the database (Sec. 1).
Requires qualifying offenders to remain on the database for 10 years (Sec. 1).
Authorizes prosecutors to apply for an extension of the period for which an individual must remain on the registry on the basis of violation of terms (Sec. 1).
Specifies that it is presumed that all individuals who have plead guilty to or been convicted of a qualifying offense will be placed on the registry (Sec. 1).
Authorizes individuals to challenge such presumption on the basis that they were not the principal offender in the offense and requires such individuals to prove this by a preponderance of the evidence (Sec. 1).
Requires individuals to register in person with their local sheriff within three days of becoming eligible for the database (Sec. 1).
Requires individuals subject to the database to inform their local sheriff in person of any change of address within three days (Sec. 1).
