Title: Limits Punitive Damages in Certain Medical Lawsuits

Vote to pass a bill that limits the amount of punitive damages that may be awarded in certain medical lawsuits.

  • Prohibits punitive damages that exceed 250 percent of compensatory damages awarded in lawsuits against the following types of defendants (Sec. 1):

    • Assisted living residences;

    • Long-term nursing care facilities; or

    • An employee or officer of either of the above types of facilities.

  • Specifies that the above limitation does not apply in the following circumstances (Sec. 1):

    • The plaintiff is a veteran;

    • The plaintiff is an unemancipated minor;

    • The plaintiff has been diagnosed with post-traumatic stress disorder;

    • The plaintiff has an intellectual disability; or

    • The court finds that the defendant acted with intent to harm, falsified medical records related to the case, or has been convicted of a crime related to the case.
