  • Prohibits holding a handheld personal communications device while driving a motor vehicle (Sec. 1).

    • Operators who are lawfully parked or stopped;

    • Use of handheld communications devices to report an emergency;

    • Use of amateur or citizens band radio; and

    • Operators of Department of Transportation vehicles.

  • Specifies the following penalties for failure to comply with this act, including, but not limited to (Sec. 1):

    • Fines of $125 and $250 for first and subsequent offenses, respectively; and

    • A mandatory fine of $250 if violation occurred in a highway work zone.
