Title: Prohibits Local Governments from Regulating, Restricting, or Taxing Auxiliary Containers
Vote to pass a bill that prohibits local governments from regulating, restricting, and taxing auxiliary containers.
Defines “auxiliary container” as a bag, cup, bottle, can, device, and eating or drinking utensil, tool whether reusable or single use which is designed for transporting food or beverages made of the following, including (Sec. 1):
Cloth, paper, or plastic;
Foamed or expanded plastic, cardboard, corrugated material; and
Aluminium, glass, or recycled material.
Defines “local government” as a county, municipality, or county with a metropolitan form of government (Sec. 1).
Prohibits a local government rom adopting or enforcing a resolution, ordinance, or regulation that (Sec. 1):
Regulates the use, disposition, or sale of an auxiliary container;
Prohibits or restricts an auxiliary container; or
Enacts a fee, charge, or tax on an auxiliary container.
Specifies that this act shall not restrict the following, including (Sec. 1):
A curbside or commercial recycling program;
A designated residential or commercial recycling location; or
The use of an auxiliary container on property owned by a local government.
