Title: Authorizes the Recreational Sale of Marijuana

Vote to pass a bill that authorizes the recreational sale of marijuana.

Highlights:

 

  • Authorizes the recreational sale of marijuana to individuals 21 years old or older and specifies the following amounts as legal under the law (Ch. 77-H).

    • Up to 21 grams (three-fourths ounce) of marijuana; or

    • Up to 5 grams of hashish including adulterants or dilutants.

  • Specifies that any individual under the age of 21 who knowingly possesses either 21 grams of marijuana or 5 grams of hashish will be guilty of a violation under this act and subject to the following penalties, including (Ch. 77-H).

    • For their first offense a fine of $100;

    • For their second offense a fine of $300; and

    • For any subsequent offense the individual will be guilty of a Class B Felony.

  • Establishes a marijuana cultivation tax rate of 5 percent of the total sales price received by the cultivation facility and a retail store tax rate of 9 percent of the total sales made from the sale of marijuana (Ch. 77-H).
