Vote Smart's Synopsis:

Vote to pass a bill that requires employers to verify their employee's immigration statuses through the federal E-verify program.

Highlights:

• Prohibits employers from knowingly employing undocumented immigrants (Sec. 2).

• Specifies that a first violation the court will require the following (Sec. 2):

• The employers will terminate the employment of all undocumented immigrants;

• The employer will be subject to a 3 years probationary period for the business location where the undocumented immigrant worked, during which the employer will file quarterly reports for each new hired employee at the location where the undocumented immigrant worked; and

• The employers will file a signed sworn affidavit with the Department of Workforce Development within 3 business days following the issuance of an order stating that the employer has terminated the employment of all unauthorized immigrants and that they will no longer employ undocumented immigrants in the future.

• Authorizes the court to order the appropriate agencies to suspend all licenses that are held by the employer if the employer fails to file a sworn affidavit within the Department within 3 business days after the order is issues, and will remain suspended until the employer signed a sworn affidavit as instructed (Sec. 2).

• Authorizes the court to order the suspension of all licenses held by the employer for no more than 10 business days, and will base its decision to suspend based on, at a minimum, the following factors (Sec. 2):

• The number of undocumented immigrants employed by the employer;

• Any prior misconduct by the employer;

• The degree of hard resulting from the violation;

• Whether the employer made good faith efforts to comply with any applicable requirements;

• The duration of the violation; and

• The role of the directors, officers, or principles of the employer in violation.

• Specifies that 2nd violations of this bill will result in a court order to the appropriate agencies permanently revoking all licenses that are held by the employer at the location where undocumented immigrants worked (Sec. 2).

• Prohibits the Department from using federal funds for personnel or other resources to carry out the duties of this bill (Sec. 6).
