Title: Authorizes the Decriminalization of Cannabis Possession

Vote to pass a bill that authorizes the decriminalization of up to an ounce of personal use cannabis.

Highlights:

  • Specifies that possession of up to 1 ounce (28 grams) of marijuana shall be classified as a Class C misdemeanor and more than 1 ounce as a Class B misdemeanor (Sec. 1).

  • Specifies that anyone charged with the above mentioned misdemeanors shall not be arrested and shall be issued a citation instead (Sec. 4).

  • Authorizes certain records relating to an above mentioned offense may be expunged under the following circumstances (Sec. 6):

    • The complaint was dismissed;

    • At least 180 days has elapsed from the date of the dismissal;

    • At least 1 year has elapsed from the date of the citation; or

    • The individual was acquitted of the offense.

  • Requires an individual to submit a written request under oath to the court to have their records expunged (Sec. 6).

  • Specifies that the court shall order all complaints, verdicts, sentences, prosecutorial and law enforcement records, and any other relating documents to the offense expunged from the individual’s record if the individual has satisfied the requirements of this act (Sec. 6).
