Title: Authorizes Online Sports Betting

Vote to pass a bill that authorizes online sports betting, effective July 1, 2019.

Highlights:

 

  • Authorizes the Commission to regulate interactive wagering and the conduct of interactive gaming and live betting under this act (Sec. 1).

  • Defines “Commission” as the Tennessee Gaming Commission (Sec. 1).

  • Defines “live betting” as a type of wager that is placed after the sporting event being wagered on has commenced and whose odds on events occurring are adjusted in real time (Sec. 1).

    • Maximum wagers which may be accepted by an operator;

    • Methods of accounting used by operators;

    • Use of credit and checks by patrons; and

    • Protections for patrons placing wagers and the promotion of social responsibility.

  • Authorizes the Commission to determine the eligibility of a person to hold or continue to hold a license, issue all licenses, accept applications, evaluate qualifications, undertake initial review, and maintain a record of all licenses issued under this act (Sec. 1).

  • Defines “license” as any permit license issued by the Commission under this act, including, but not limited to (Sec. 1):

    • A license to act as an agent of the Commission in operating interactive wagering at a licensed gaming facility;

    • A license to supply a gaming facility with interactive wagering equipment or services necessary for the operation; or

    • A license to be employed.

  • Authorizes the Commission to levy and collect all fees, surcharges, civil penalties, and weekly tax on adjusted gross interactive wagering receipts imposed by this article (Sec. 1).

  • Authorizes the Tennessee Bureau of Investigation to issue subpoenas along with the following penalties for accepting wagers from minors under the age of 21 or individuals without a sports wagering license, including (Sec. 1):

    • For minors:

      • First offense a fine of $1,000;

      • Second offense a fine of $2,000; and

      • Third and subsequent offenses a fine of $5,000.

    • For Individual without a sports wagering license;

      • First offense a fine of $10,000;

      • Second offense a fine of $15,000;

      • Third and subsequent offenses a fine of $25,000.

  • Prohibits any individual from engaging in any activity in connection with Tennessee Lottery interactive wagering in this state unless all necessary licenses have been obtained in accordance with this act (Sec. 1).
