Title: Authorizes Private Marijuana Cultivation

Vote to pass a bill that authorizes private marijuana cultivation.

Highlights:

 

  • Authorizes a designated caregiver to cultivate marijuana for therapeutic use, and permits qualifying patients and designated caregivers to donate excess marijuana to other qualifying patients (Sec. 1).

  • Authorizes the cultivation of marijuana for therapeutic use as long as the cultivation does not exceed the following (Sec. 6):

    • Eight ounces of usable marijuana;

    • Any amount of unusable marijuana; and

    • Three mature marijuana plants, 3 immature marijuana plants, and 12 seedlings, where the plants are not publicly viewable.

  • Defines “designated caregiver” as an individual who (Sec. 2):

    • Is at least 21 years old;

    • Has agreed to assist with one or more (no more than 5) qualifying patients in the therapeutic use of marijuana;

    • Has agreed to cultivate marijuana for therapeutic use;

    • Has never been convicted of a felony or any drug-related offense; and

    • Possesses a valid registry identification card.

  • Defines “seedling” as a marijuana plant that is less than 6 inches tall (Sec. 4).

  • Specifies that an alternative treatment center shall not be limited in the number of seedlings it can possess or cultivate (Sec. 17).
