Title: Amends Criminal Sentencing Laws
Vote to concur with house amendments and pass a bill that amends criminal sentencing laws, effective November 1, 2019.
Authorizes a court to resentence an individual, either by trial or plea, that has been sentenced to a crime that would, as of July 1, 2017 been found guilty as a misdemeanor (Sec. 1).
Prohibits a hearing from being conducted to modify a sentence unless requested by the individual (Sec. 1).
Requires that a individual whose sentence is modified be given credit for time served (Sec. 1).
Requires that any individual be considered for an accelerated deferred judgement for an offense where the penalty has been subsequently been lowered from a felony to a misdemeanor (Sec. 4).
Authorizes the Pardon and Parole Board to establish an accelerated single-stage commutation docket for any individual convicted of a crime that has been reclassified from a felony to a misdemeanor (Sec. 5).
Specifies that if a court determines that an applicant is entitled to have his or her conviction reclassified as a misdemeanor then the conviction shall be considered a misdemeanor for all purposes (Sec. 7).
