Vote to pass a bill that establishes procedural requirements for abortions that result in the premature birth of a child.

Highlights:

 

  • Requires a health care practitioner exercise the same degree of professional skill, care and diligence as they would to any child born under normal conditions for any child born alive during an attempted abortion procedure (Sec. 1).

  • Specifies that any health care provider or employee of a hospital, physician’s office, or clinic where abortions are performed or induced who has knowledge of a failure to comply with a requirement immediately report the failure to an appropriate law enforcement agency (Sec. 1).

  • Prohibits the mother of a child born alive from being prosecuted for a violation, or attempt and conspiracy to commit a violation involving the child who was born alive, and requires that courts keep the identity of the individual confidential with the use of a pseudonym unless they opt out of such protections (Sec. 1 & 2).

  • Specifies that any individual found to have intentionally performed or attempt to perform an overt act that kills a child born alive shall be guilty of a Class A felony (Sec. 2).
