Title: Prohibits State Sanctuary City Laws

Vote to concur with senate amendments and pass a bill that prohibits state sanctuary city laws.

Highlights:

 

  • Prohibits a state entity, law enforcement agency, or local governmental entity from adopting or enacting a sanctuary policy (Sec. 1).

  • Prohibits a state entity, local governmental entity, or law enforcement official from restricting a law enforcement agency from taking any of the following actions regarding a person’s immigration status (Sec. 1):

    • Sending, requesting, receiving, or reviewing information from a federal immigration agency;

    • Recording and maintaining the information;

    • Exchanging the information with a federal immigration agency or another state or local entity;

    • Using the information to comply with an immigration detainer; or 

    • Using the information to confirm the identity of a detained person.

  • Authorizes the Department of Corrections to transport a person who is subject to an immigration detainer to a federal facility in the state or to another point of transfer outside of the jurisdiction of the law enforcement agency (Sec. 1). 

  • Specifies that state and local entities are not required to provide a federal immigration agency with information related to a victim or a witness to a criminal offense (Sec. 1).

  • Prohibits a law enforcement agency from detaining an undocumented immigrant solely because they were the victim of or witness to a criminal offense (Sec. 1).

  • Authorizes the Governor to initiate judicial proceedings against officers who violate the provisions of this act (Sec. 1). 

  • Authorizes the Attorney General to file suit against a local governmental entity or law enforcement agency that violates this act (Sec. 1).

  • Specifies that this act does not apply to the release of information contained in education records (Sec. 1).

  • Prohibits a state entity, local governmental entity, law enforcement entity, or any employee of these entities from basing their actions under this act on the gender, race, religion, national origin, or physical disability of any person (Sec. 1).

  • Requires any sanctuary policy that is in effect on the effective date of this act to be repealed within 90 days after that date (Sec. 2).
