Vote to pass a bill that prohibits genetic information usage by health insurance companies for policies entered into or renewed on or after January 1, 2021.

Highlights:

• Defines “genetic information” as information derived from genetic testing to determine the presence or absence of variations or mutations, including carrier status, in an individual’s genetic material or genes that is scientifically or medically believed to cause a disease, disorder, or syndrome, or is associated with a statistically increased risk of developing a disease, disorder, or syndrome, which is asymptomatic at the time of testing (Sec. 1).

• Defines “life insurer” as an insurer engaged in the business of issuing life insurance contracts, including contracts of combined life and health and accident insurance, and includes issuing life insurance contracts that grant additional benefits in the event of the insured’s disability (Sec. 1).

• Prohibits health insurers, life insurers, and long-term care insurers, in the absence of a diagnosis of a condition related to genetic information, from canceling, limiting, denying coverage, or establishing differentials in premium rates based on such information (Sec. 1).

• Prohibits health insurers, life insurers, and long-term care insurers from requiring or soliciting genetic information, using genetic test results, or considering a person’s decisions or actions relating to genetic testing for any insurance purpose (Sec. 1).

• Specifies that this act applies to policies entered into or renewed on or after January 1, 2021 (Sec. 2).
