Title: Born-Alive Abortion Survivors Protection Act

Vote on a motion to invoke cloture on a bill that establishes requirements for health care practitioners to exercise in the event that a child is born alive following an attempted abortion.

Highlights:

 

  • Requires a health care practitioner who is present at the time that a child is born after an attempted abortion to (Sec. 3):

    • Exercise the same degree of professional skill, care, and diligence to preserve the life and health of the child they would render to any other child born at the same gestational age; and 

    • Ensure that the child is immediately transported and admitted to a hospital. 

  • Requires a health care practitioner or an employee of a hospital, a physician’s office, or an abortion clinic who has knowledge of a failure to comply with the requirements listed above to immediately report the failure to an appropriate state or federal law enforcement agency (Sec. 3).

  • Specifies that whoever violates the above requirements will be fined, imprisoned up to 5 years, or both (Sec. 3).

NOTE: THIS IS A VOTE TO INVOKE CLOTURE ON A MOTION TO PROCEED, WHICH SENDS THE LEGISLATION TO THE FLOOR OF THE SENATE FOR DEBATE AND AMENDMENT. A MOTION TO PROCEED ALONE REQUIRES A MAJORITY FOR APPROVAL. HOWEVER, THE MOTION CAN BE FILIBUSTERED, AND WHEN THIS OCCURS, A CLOTURE VOTE IS NECESSARY TO VOTE ON THE MOTION TO PROCEED. A THREE-FIFTHS MAJORITY OF THE SENATE IS NECESSARY TO INVOKE CLOTURE.
