Vote to pass a bill that increases the legal age to buy tobacco products to 21.

Highlights:

• Prohibits a person from knowingly, intentionally, or negligently selling, offering to sell, bartering, or giving a tobacco product to a minor (Sec. 3).

• Defines “minor” as an individual who is younger than 21 years of age (Sec. 2).

• Prohibits a licensee from selling, offering to sell, or delivering a tobacco product in a form other than an original manufacturer-sealed package, except for individually sold cigars or loose leaf pipe tobacco (Sec. 3).

• Prohibits a licensee from selling, offering to sell, or deliver nicotine liquid in this state, unless such liquid is in child-resistant packaging (Sec. 3).

• Specifies that “nicotine liquid” does not include nicotine liquid in a cartridge that is pre-filled and sealed by the manufacturer that is not intended to be opened by the consumer (Sec. 3).

• Prohibits a manufacturer from producing and a distributor or retailer from selling tobacco products that are knowingly attractive to minors (Sec. 3).

• Defines “tobacco product” as a product made or derived from tobacco or nicotine that is intended for human consumption, whether smoked, chewed, absorbed, dissolved, inhaled, snorted, sniffed, or ingested by any other means, including cigars, cigarettes, chewing tobacco, pipe tobacco, snuff, e-cigarettes, or electronic delivery systems (Sec. 2).
