Title: Authorizes Alcohol Delivery by Third Party Platforms

Vote to pass a bill that authorizes third-party deliver service to deliver alcohol through contract workers.

Highlights:

 

  • Defines “third party platform” as a third party service that is licensed to do business in the state of Louisiana that performs work with its own employees or agents for which the platform is required to file an Internal Revenue Service Form W-2 or 1099 (Sec. 241).

  • Authorizes permits to be issued to a restaurant establishment enabling the delivery of restaurant prepared food and malt beverages, sparkling wine, and still wine with its own employees or agents for which the retailer is required to file and Internal Revenue Service Form W-2 or 1099 (Sec. 271.2).

  • Authorizes a retail dealer possessing certain permits to enter into a written agreement with a third party delivery company or a third party platform for the use of an internet or mobile application or similar technology platform to facilitate the sale of alcoholic beverages for delivery to consumers for personal consumption, and authorizes the third party delivery company or the third party platform to deliver alcoholic beverages to the consumer (Sec. 308).

  • Prohibits any parish that has a population of less than 100,000 from delivering alcoholic beverages more than 25 miles from the place of purchase (Sec. 308).

  • Prohibits any parish that has a population greater than 100,000 from delivering alcoholic beverages more than 10 miles from the place of purchase (Sec. 308).

  • Requires a retail dealer entering into an alcoholic beverage delivery agreement with a third party delivery company or a third party platform to verify that (Sec. 308):

    • The third party delivery company or the third party platform is properly registered and authorized to conduct business in Louisiana;

    • The third party delivery company or the third party platform holds a valid Louisiana alcoholic beverage permit;

    • The third-party third party delivery service company or the third party platform maintains a general liability insurance policy with a liquor liability endorsement in an amount no less than one million dollars per occurrence for the duration of the agreement with the retail dealer and provides proof of coverage to the retail dealer;

    • The third party delivery company or the third party platform is able to monitor the routes of its employees or agents during alcoholic beverage deliveries;

    • The third party delivery company or the third party platform conducts a screening and a background check of all persons that will deliver alcoholic beverages.

  • Authorizes a licensed third party delivery company or third party platform to act as an agent of a retail dealer for the purposes of processing, assembling, packaging, and fulfilling alcoholic beverage orders for delivery from the retailer’s licensed premises (Sec. 308).
