Vote to concur with Senate amendments and pass a bill that establishes the National Parks and Public Land Legacy Restoration Fund and appropriates permanent funding for the Land and Water Conservation Fund.

Highlights:

• Establishes the National Parks and Public Land Legacy Restoration Fund within the United States Department of the Treasury (Sec. 2).

• Appropriates 50 percent of all energy development revenues due to the US from oil, gas, coal, or alternative or renewable energy development on federal land and water in the preceding year into the Fund for each fiscal year 2021-2025 (Sec. 2).

• Prohibits the amount deposited into the Fund from exceeding $1.9 billion in any fiscal year (Sec. 2).

• Requires the amounts deposited into the Fund for each fiscal year to be used for priority deferred maintenance projects in the National Park System (NPS), in the National Wildlife Refuge System, on public land administered by the Bureau of Land Management (BLM), for the Bureau of Indian Education (BIE) schools, and in the National Forest System as follows (Sec. 2):

• 70 percent will be allocated to the NPS;

• 15 percent will be allocated to the US Forest Service; 

• 5 percent will be allocated to the US Fish and Wildlife Service; 

• 5 percent will be allocated to the BLM; and

• 5 percent will be allocated to the BIE.

• Requires, within each agency, no less than 65 percent of the amounts allocated from the Fund to be allocated for non-transportation projects (Sec. 2).

• Establishes permanent, full funding of the Land and Water Conservation Fund (LWCF) (Sec. 3).

• Requires the president to submit to a report to Congress of allocations made to the LWFC on an annual basis (Sec. 3).

• Requires the US Comptroller General to conduct a study on the implementation of this act, including whether it has effectively reduced the priority of deferred maintenance backlog (Sec. 2).

• Defines a “project” as any activity to reduce or eliminate deferred maintenance of an asset, which may include resolving directly related infrastructure deficiencies of the asset that would not by itself be classified as deferred maintenance (Sec. 2).

• Defines an “asset” as any property, including any physical structure, landscape, trail, or other tangible property that has a specific service or function and is tracked and managed as a distinct, identifiable entity (Sec. 2).
