Vote to concur with the governor's recommendation and pass a bill that authorizes law enforcement agencies to operate photo speed monitoring devices in or around school crossing zones and highway work zones.

Highlights:

• Defines “photo speed monitoring device” as equipment that uses radar or light detection and ranging (LIDAR)-based detection and produces one or more photographs, microphotographs, videotapes, or other recorded images of vehicles (Sec. 46.2).

• Authorizes a state or local law enforcement agency to place or operate a photo monitoring device in school crossing zones or highway work zones for the purposes of recording violations (Sec. 46.2).

• Requires the operator of a motor vehicle who is found to have violated local speed laws by going at least 10 miles over the posted speed limit in a school crossing zone or highway work zone with the use of a photo speed monitoring device, to be liable to pay for any monetary civil penalty imposed by the violation (Sec. 46.2).

• Requires the aforementioned monetary civil penalty to be no greater than $100 and any prosecution imposed from said violation to be instituted and conducted in the same manner as prosecution for traffic infractions (Sec. 46.2).

• Authorizes a private vendor to enter into a contract or agreement with a law enforcement agency in order to be compensated for providing photo speed monitoring devices (Sec. 46.2).

• Requires a conspicuous sign be posted within 1,000 feet of any school crossing zone or highway work zone that has a photo monitoring device in use (Sec. 46.2).

• Requires, by January 15 of each year, all local law enforcement agencies to report to the Department of State Police on the number of traffic violations prosecuted, the number of successful prosecutions, and the total amount of monetary civil penalties collected (Sec. 46.2).
