Title: Increases the Legal Smoking Age to 21

Vote to concur with House amendments and pass a bill that increases the legal smoking age to 21, effective January 1, 2021.

Highlights:

 

  • Prohibits a person from selling tobacco products to an individual who is not 21 years of age or older (Sec. 1).

  • Specifies that a violation of the above highlight by a person other than an individual who is not 21 years of age or older is a misdemeanor of the first degree (Sec. 1).

  • Prohibits a person from selling, delivering, bartering, furnishing, or giving flavored nicotine products to any other person (Sec. 6).

  • Defines “tobacco products” as (Sec. 4):

    • Loose tobacco leaves, products made from tobacco leaves, and cigarette wrappers; and

    • Any nicotine product or vapor-generating electronic device.

  • Defines a “vapor-generating electronic device” as any product that employs an electronic, chemical, or mechanical means capable of producing vapor or aerosol from a nicotine product or any other substance, including but not limited to, an electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, or another similar device (Sec. 4).

  • Defines a “nicotine product” as a product that contains nicotine, including liquid nicotine, which is intended for human consumption, whether inhaled, chewed, absorbed, dissolved, or ingested, and includes vapor-generating electronic devices (Sec. 4).

  • Defines a “flavored nicotine product” as a liquid nicotine product containing a natural or artificial constituent or additive that causes the liquid or its vapor to have a distinguishable taste or aroma other than tobacco or menthol, including but not limited to, fruit, chocolate, vanilla, honey, candy, cocoa, a dessert, an alcoholic beverage, an herb or a spice, or any combination thereof (Sec. 6).
