Vote to concur with Senate amendments and pass a bill that establishes a system to automatically set aside certain convictions under certain circumstances.

Highlights:

• Requires misdemeanor convictions for which the maximum punishment is imprisonment for not more than 92 days to be set aside if 7 years have passed from the imposition of the sentence (Sec. 1g).

• Requires misdemeanor offenses for which the maximum punishment is imprisonment for 93 days or more to be set aside if 7 years have passed from the imposition of the sentence (Sec. 1g).

• Requires felony convictions to be set aside if 10 years have passed from the latter of either the imposition of the sentence or the completion of any term of imprisonment for the conviction (Sec. 1g).

• Specifies that the following convictions are not eligible to be set aside (Sec. 1g):

• An assaultive crime;

• A serious misdemeanor;

• A crime of dishonesty; 

• Any violation related to human trafficking; and

• Any other offense that is punishable by 10 or more years of imprisonment.

• Specifies that not more than 2 felony convictions and 4 misdemeanor convictions total may be set aside during the lifetime of an individual (Sec. 1g).
