Highlights:

• Specifies that an employer is not liable for an employee’s exposure to COVID-19 if at the time of exposure, the employer was operating in compliance with applicable (Sec. 85):

• Federal or state statutes or regulations;

• Executive orders;

• State agency orders; and 

• Public health guidance.

• Specifies that an employer does not qualify for liability immunity if the employer willfully exposed an employee to COVID-19, outside of a healthcare setting (Sec. 85).
