Title: Limits Certain Powers of the Governor for the Declaration of an Emergency

  • Authorizes the legislature to by petition, terminate an entire state of emergency or public health emergency and establish an unlimited period of time during which the governor shall be prohibited to issue any other declaration of state of emergency or public health emergency (Pg. 2).

  • Prohibits the governor from issuing any further declarations or extensions of declarations intended to address the COVID-19 pandemic and limit the suspension for a short period of time (Pg. 2). 

  • Repeals the previously passed emergency powers which grant the governor the authority to declare or renew a state of emergency or public health emergency only as they apply to the COVID-19 pandemic (Pg. 3).

  • Establishes that this act shall become effective upon adoption of the resolution and shall extend 30 days past the final adjournment date of the legislative session (Pg. 3).
