Title: Reduces Mandatory Minimum Sentences

A vote to pass a bill that reduces the Mandatory Minimum Sentences and redefines criminal statutes.

Highlights:

 

  • Amends previous law to state that a court shall sentence an individual convicted a misdemeanor, besides a serious misdemeanor, with the following, including (Sec. 5):

    • A fine;

    • Community service; or

    • Other non-jail or non-probation sentence.

  • Authorizes a court to hold an individual in contempt, and impose an additional sentence, including jail or probation if the court determines that the sentenced individual has not complied with their non-jail or non-probation sentence (Sec. 5).

  • Specifies that if a court determines that an individual is in contempt of court for the nonpayment of fines, costs, or other legal obligations, the court shall be required to document that an individual's failure to pay was not due to manifest hardship before imposing an additional sentenc
