Vote to amend and pass a bill that authorizes businesses, organizations, and schools to remain open if they are following CDC guidelines regardless of governor mandate.

Highlights:

  • Authorizes any business, for-profit or not-for-profit organization, association, church, religious institution, or any school, public, private, or religiously affiliated, to remain open and operational so long as it obtains and follows a comprehensive operating plan that (Sec. 1):

    • Meets or exceeds all applicable guidance issued by the Centers for Disease Control and Prevention;

    • Details how the business, for-profit or not-for-profit organization, association,church, religious institution, or school, whether public, private, or religiously affiliated, will operate to allow employees, customers, attendees and patrons to remain safe, including social distancing requirements;

    • Is posted in a conspicuous place on the main entrance door of the physical location of the business, for-profit or not-for-profit organization, association, church, religious institution, or school, whether public, private, or religiously affiliated, and on the Web site of the business, for-profit or not-for-profit organization, association, church, religious institution, or school, whether public, private, or religiously affiliated, if one exists; and

    • Has been submitted to the local health department

  • Requires The Cabinet for Health and Family Services shall develop regulations and guidelines authorizing and regulating visitation by family members or legal guardians that are designated as being important to the mental, physical, or social well-being of the resident in residential long-term care facilities (Sec. 1-4).

  • Prohibits any state or local agency from enforcing restrictions that exceed current applicable guidelines issued by the Centers for Disease Control and Prevention (Sec. 1-4.c).
