Highlights:

 

  • Authorizes judges to impose the following sentences for individuals convicted of Class A, B, C and D felonies (Sec. 1) 

    • If the imposed sentence is 15 years, then the judge may order no more than 3 years within a jail-type facility and then suspend the rest of the sentence so that the offender may be placed on probation; 

    • If the imposed sentence is more than 15 years but less than 20 for a Class A or B felony, the judge may order a 3-5 year sentence then suspend the remainder of the sentence and place the offender on probation; 

    • If the imposed sentence is more than 15 years for a Class C felony, the judge may order a 3-year sentence and suspend the rest, and then place the offender on probation; or

    • If the imposed sentence is 15 years for a class D felony, the judge may suspend the sentence all the together and place the offender on high-intensity probation 

  • Authorizes judges to determine the length of revocation sentences if inmates violate the condition of their probation under these new provisions, provided that the revocation sentence does not exceed the length of the statutorily imposed sentence (Sec. 1).
