Vote to pass a bill that amends cannabis possession while driving laws to clarify that only the at fault driver involved in an accident shall receive a felony cannabis possession charge.

Highlights:

 

  • Specifies that a person has committed a class C misdemeanor if they are operating a vehicle with (Sec. 1):

    • An equivalent of at least 800 gram of alcohol but less than 1,500 gram per 100 grams of blood; or

    • That equivalent per 210 liters of the person’s breath.

  • Specifies that a person has committed a class A misdemeanor if they are operating a vehicle with (Sec. 1):

    • An alcohol concentration of at least 1,500 gram of alcohol per 100 grams of blood; or 

    • Per 210 liters of the person’s breath.

  • Specifies that a person who operates a vehicle with a controlled substance commits a class C misdemeanor unless (Sec. 1):

    • The controlled substance was a valid prescription;

    • The controlled substance was marijuana;

    • The person was not intoxicated; and

    • The person didn’t cause an accident.
