Title: American Dream and Promise Act of 2021

Vote Smart's Synopsis:

Vote to pass a bill that amends previous immigration laws to provide a path toward citizenship for DREAMers.

Highlights:

 

  • Authorizes the Secretary of the Department of Homeland Security (DHS) or the Attorney General of the Department of Justice (DOJ) to provide conditional permanent resident status for an undocumented individual who is deportable or inadmissible, has deferred enforced departure (DED) status, or temporary protected status (TPS) for an additional 10 years if they meet the following requirements, including, but not limited to (Title I, Sec. 102-103):

    • Is the child of certain classes of nonimmigrants;

    • Has been physically present in the United States since January 1, 2021;

    • Was 18 years old or younger at the date on which they entered the United States;

    • Been admitted to or is enrolled at an institution of higher education or a career and technical education school at the postsecondary level;

    • Has obtained a high school diploma or commensurate alternative award from a public or private high school;

    • Passed the General Education Development test, high school equivalency diploma examination, or another similar state-authorized exam; and

    • Completes and passes a background check.

  • Authorizes the DHS to remove the aforementioned conditions to attaining permanent residence status if the undocumented individual has or is eligible for TPS or DED status, or does the following, including (Title I, Sec. 104):

    • Serves in the military for at least 2 years, and if discharged, has an honorable discharge;

    • Has obtained a degree from an institution of higher education or completed at least 2 years in good standing; or

    • Demonstrates earned income for a period totalling at least 3 years.

  • Requires the DHS Secretary to establish a streamlined procedure for individuals who have been granted Deferred Action for Childhood Arrivals (DACA) and meet the aforementioned requirements and conditions (Title I, Sec. 102).

  • Establishes an application fee for obtaining temporary permanent residence status that does not exceed $495 (Title I, Sec. 102).

  • Repeals the restriction prohibiting states from providing higher education benefits to undocumented individuals unless they are available to all US nationals regardless of state residency (Title I, Sec. 105).

  • Prohibits the DHS Secretary from disclosing or using information provided in applications filed under this act or in requests for DACA for immigration enforcement purposes (Title III, Sec. 309).
