Vote Smart's Synopsis:

Vote to pass a bill that rescinds marijuana possession offenses of two ounces of marijuana or less.

Highlights:

• Extends immunity to individuals convicted of unlawful possession of marijuana if committed on or after March 1, 2020, for 2 ounces or less (Sec. 1.c).

• Establishes a person under 21 years of age who possesses 2 ounces or less of marijuana or consumes marijuana anywhere in the state of Colorado commits illegal possession or consumption of marijuana by an underage person. Illegal possession or consumption of marijuana by an underage person is a strict liability offense (Sec. 2).

• Specifies consumption or use of marijuana or marijuana concentrate is deemed possession thereof, and violations must be punished accordingly (Sec. 3.b-III).

• Specifies juvenile court has jurisdiction concerning the illegal possession or consumption of ethyl alcohol or marijuana by an underage person or illegal possession of marijuana paraphernalia by an underage person (Sec. 5).

• Establishes a motion filed for the sealing of a petty offense, or a petty drug offense, will cause the court to order that the records be sealed after the motion is filed and the criminal history filed with the court documents to the court that the defendant has not been convicted of a criminal offense since the date of the final disposition of all criminal proceedings against the defendant or since the date of the defendant's release from supervision, whichever is later (Sec. 6.f.I).

• Specifies the provisions of this section do not apply to records pertaining to a conviction that is subject to sentencing for an offense classified as a class 1, 2, or 3 felony or a level 1 drug felony according to any section of title 18 (Sec. 6-2.a).
