Title: COVID-19 Hate Crimes Act

Vote to pass a bill that requires the Department of Justice facilitate the expedited review of COVID-19 hate crimes.

Highlights:

 

  • Requires the Attorney General and the Department of Justice (DOJ) to, within 7 days after the enactment of this bill, facilitate the expedited review of hate crimes and reports of such hate crimes to federal, state, local, or tribal law enforcement agencies (Sec. 3).

  • Requires the DOJ issue guidance for state, local, and tribal law enforcement agencies on the following, including (Sec. 4):

    • Establishing online hate crime reporting processes and guidelines;

    • Collecting data disaggregated by race or national origin; and

    • Expanding education campaigns aimed at raising awareness of the rise in hate crimes during the COVID-19 pandemic.

  • Establishes grants for states to create state-run hate crime reporting hotlines (Sec. 5).

  • Authorizes states to implement the National Incident-Based Reporting System and conduct law enforcement activities or crime reduction programs to prevent, address, and respond to hate crimes (Sec. 5).

  • Requires an individual convicted of a hate crime offense and placed on supervised release to participate in educational classes or community service as a condition of supervised release (Sec. 5).

NOTE: THIS IS A VOTE TO INVOKE CLOTURE ON A MOTION TO PROCEED, WHICH SENDS THE LEGISLATION TO THE FLOOR OF THE SENATE FOR DEBATE AND AMENDMENT. A MOTION TO PROCEED ALONE REQUIRES A MAJORITY FOR APPROVAL. HOWEVER, THE MOTION CAN BE FILIBUSTERED, AND WHEN THIS OCCURS, A CLOTURE VOTE IS NECESSARY TO VOTE ON THE MOTION TO PROCEED. A THREE-FIFTHS MAJORITY OF THE SENATE IS NECESSARY TO INVOKE CLOTURE.
