Vote to concur with amendments and pass a bill that requires collecting data from all state law enforcement agencies on deadly encounters and agencies to report their data annually to the Criminal Justice Commission at the legislature and the FBI.

Highlights:

 

  • Requires a law enforcement agency to collect and report use-of-force incidents involving law enforcement officers to the Arizona Criminal Justice Commission beginning January 1, 2022 (Sec. 1.A).

  • Requires the Arizona Criminal Justice Commission to establish procedures governing the collection and reporting of use-of-force incident data that are consistent with the requirements, definitions, and methods of the national use-of-force data collection (Sec. 1.B).

  • Requires the Arizona Criminal Justice Commission to publish the data reported during the immediate past year beginning March 1, 2023, and on or before March 1 of each year thereafter (Sec. 1.C).

  • Requires the Arizona Criminal Justice Commission to analyze law enforcement agency use-of-force rates reported to release the analysis of trends or disparities in the use-of-force incident data (Sec. 1.D).

  • Classifies a "use-of-force incident” as an incident in which any of the following occurs (Sec. 1.E-4):

    • A law enforcement officer's use of force is connected to a person's death;

    • A law enforcement officer's use of force is connected to a person receiving a serious physical injury; and

    • In the absence of death or serious physical injury, a law enforcement officer discharged a firearm at or in the direction of a person.
