Vote to pass a bill that repeals the practice of suspending people's driver's licenses when they can't afford to pay fines and fees for minor traffic offenses.

Highlights:

 

  • Requires any collection fee imposed to be assessed on a per case basis and not on a per charge basis. The provisions of this law must not be construed to apply to any credit card processing fees that are assessed solely to recoup any costs incurred to process a credit card payment (Sec. 1-5).

  • Requires the Department of Motor Vehicles to, upon receiving notification from a district attorney or other public agency collecting support for children that a court has determined that a person (Sec. 2-1):

    • Has failed to comply with a subpoena or warrant relating to a proceeding to establish paternity or to establish or enforce an obligation for the support of a child; or

    • If in arrears in the payment for the support of one or more children, send a written notice to that person that his or her driver’s license is subject to suspension.

  • Requires the notice to include (Sec. 2-2):

    • The reason for the suspension of the license;

    • The information outlined in subsections 3, 5, and 6; and

    • Any other information the Department deems necessary.

  • Prohibits the Department from requiring a person whose driver’s license was suspended to submit to the tests and other requirements which are adopted by regulation as a condition of the reinstatement of the license (Sec. 2-6).

  • Requires the Department to revoke the license, permit, or privilege of a driver who fails to complete the educational course on the use of alcohol and controlled substances within the time ordered by the court and will add 90 days during which the driver is not eligible for a license, permit or privilege to drive (Sec. 3-2).

  • Transfers $14,950 from the State Highway Fund to the Department of Motor Vehicles for the costs of providing the notification (Sec. 3.5).

  • Prohibits the Department of Motor Vehicles from (Sec. 4-2):

    • Charging any fee for the reinstatement of the driver’s license of a person following this section; or

    • Requiring a person to undergo any physical or mental examination to be eligible for reinstatement of his or her driver’s license.
