Title: Requires Presenting Valid Identification to Request an Absentee Ballot Online

Vote to amend and pass a bill that requires presenting valid identification in order to request an absentee ballot online.

Highlights:

 

  • Defines "manner of holding an election" as the procedure of voting and not the administrative function of the commission (Sec. 1.b).

  • Prohibits a person from providing an individual with an application for an absentee ballot with the following information already printed or otherwise set forth on the application when provided to the individual (Sec. 1.d):

    • The address to which the absentee ballot would be mailed, if different from the voter registration address of the individual;

    • In a primary election, the major political party ballot requested by the individual;

    • In a primary or general election, the types of absentee ballots requested by the individual;

    • The reason why the individual is entitled to vote an absentee ballot:

      • By mail; or

      • Before an absentee voter board (other than an absentee voter board located in the office of the circuit court clerk or a satellite office); or

    • The voter identification number of the individual.

  • Requires the form of the application for an absentee ballot to do all of the following (Sec. 3.b):

    • Require the applicant to swear to or affirm under the penalties of perjury that all of the information set forth on the application is true to the best of the applicant's knowledge and belief;

    • Require a person who assisted with the completion of the application to swear or affirm under the penalties of perjury the statements outlined in this law;

    • Serve as a verified statement for a voter to indicate a change of name. The form must require the applicant to indicate the applicant's previous name; and

    • Set forth the penalties for perjury.

  • Authorizes a person to provide an individual with an application for an absentee ballot with the following information already printed or otherwise set forth on the application when provided to the individual (Sec. 2.c):

    • The name of the individual;

    • The voter registration address of the individual;

    • The mailing address of the individual; and

    • The date of birth of the individual.

  • Requires an individual to include either of the following in the individual's absentee ballot application (Sec. 2.f):

    • The voter's 10 digit Indiana driver's license number; or

    • The last 4 digits of the voter's Social Security number.

  • Requires the county election board to deny any absentee ballot application (Sec. 2.g):

    • That does not include the voter's 10 digit Indiana driver's license number or the last 4 digits of the voter's Social Security number; or

    • Where the voter's 10 digit Indiana driver's license number or the last 4 digits of the voter's Social Security number do not match the numbers on record in the election board's file for the individual.

  • Prohibits this law from granting the governor the power to declare by executive order a different time, place, or manner for holding elections, including not having the authority to institute, increase, or expand vote by mail or absentee vote by mail (Sec. 5.d-1).
