Title: PFAS Action Act of 2021

Vote to pass a bill that establishes requirements and incentives to limit the use of perfluoroalkyl and polyfluoroalkyl substances, commonly referred to as PFAS, and to remediate PFAS in the environment.

Highlights:

 

  • Establishes testing requirements and incentives to limit the use of perfluoroalkyl and polyfluoroalkyl substances (PFAS) in order to remediate PFAS in the environment (Sec. 3).

  • Requires the Environmental Protection Agency (EPA) to designate PFAS, perfluorooctanoic acid (PFOA), and perfluorooctanesulfonic acid (PFOS) as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act of 1989 (Sec. 2).

  • Authorizes the EPA to review the aforementioned hazardous substances designation after 5 years (Sec. 2).

  • Requires the EPA to determine whether PFAS shall be designated as toxic pollutants under the Clean Water Act and establish standards to limit discharges of PFAS from industrial sources into United States waters (Sec. 2).

  • Requires the EPA to issue primary drinking regulations for PFAS that includes standards for PFOA and PFOS (Sec. 2).

  • Requires the EPA to issue final rules adding PFOA and PFOS to the list of hazardous air pollutants, as well as test all PFAS for toxicity to human health, and to regulate the disposal of materials containing PFAS (Sec. 8).

  • Establishes various grants to help community water systems treat water contaminated by PFAS (Sec. 7).
